Section 11-1-31 - Death of parties on bonds having force of judgment

Where execution may be issued on any bond or undertaking, and some of the parties are dead, it may be issued separately against such as are alive, and citation may be issued to the personal representatives of such as are dead, to show cause against the issuance of execution against them on such bond or undertaking; and on the return of such citation executed, if no sufficient cause be shown against it, execution may be issued against them.Codes, 1880, § 2302; 1892, § 943; 1906, § 1019; Hemingway's 1917, § 739; 1930, § 762; 1942, § 1677.
