Section 11-1-35 - Death of parties on bonds having force of judgment; when citation issued and returnable

Citations referred to in Section 11-1-33 may be issued in vacation or in term time without any order of court therefor, and may be made returnable on the return day for other process, if issued in vacation, or forthwith, if issued during the term of court, and shall be executed five days before judgment or execution against such personal representatives.Codes, 1880, § 2304; 1892, § 945; 1906, § 1021; Hemingway's 1917, § 741; 1930, § 764; 1942, § 1679.
