Section 11-21-23 - Assignment of shares and owelty

Instead of making an allotment of shares by ballot, the special commissioners may assign shares to the parties entitled, if so directed by the court or chancellor, or if they find it desirable, and in any case, if an equal partition in kind cannot be made otherwise, or so advantageously, the special commissioners may assess the amount of money to be paid by one or more of the cotenants to another or others, so as to equalize their respective shares.Codes, 1871, § 2567; 1880, § 2564; 1892, § 3107; 1906, § 3531; Hemingway's 1917, § 2843; 1930, § 2930; 1942, § 971; Laws, 1958, ch. 244.
