Section 11-53-49 - Costs in cases of setoff

When a setoff is pleaded or filed and established, the defendant shall recover of the plaintiff his costs expended in establishing it, although judgment be rendered in favor of the plaintiff for a balance due him.Codes, 1880, § 2385; 1892, § 885; 1906, § 962; Hemingway's 1917, § 671; 1930, § 678; 1942, § 1589.
