Section 21-19-39 - Adoption of ordinances regulating sale at retail of goods and services on Sunday

(1) From and after July 1, 1986, the governing authorities of counties and municipalities may adopt, in the manner provided by law, ordinances regulating, restricting and prohibiting the sale of goods and services at retail on the day of the week commonly called 'Sunday.' Such ordinances may regulate, restrict or prohibit such sales by types and kinds of goods and services and may also regulate and restrict the hours during which such goods and services may be sold or offered for sale.(2) All valid ordinances of any county or municipality regulating, restricting or prohibiting the sale of goods and services on Sunday adopted prior to July 1, 1986, pursuant to the authority granted by and in conformity with the provisions of any of the laws amended or repealed by Chapter 302, Laws of 1986, shall be and the same are hereby declared to be null and void from and after July 1, 1986; provided, however, any ordinance adopted under the provisions of any other laws of this state shall not be affected.Codes, 1906, § 3372; Hemingway's 1917, § 5869; 1930, § 2450; 1942, § 3374-154; Laws, 1950, ch. 491, § 154; Laws, 1986, ch. 302, § 1, eff.
