Section 33-13-421 - Appellate counsel

The counsel and defense counsel of a court-martial shall serve in the capacity of appellate counsel upon an appeal authorized under this code. The accused has the additional right to be represented by civilian counsel at his own expense. Should the defense or trial counsel become unable to perform their duties because of illness or other disability, the convening authority will appoint a qualified trial or defense counsel to continue the proceedings.Codes, 1942, § 8529-70; Laws, 1966, ch. 538, § 70; Laws, 1981, ch. 362, § 67, eff. 7/1/1981.
