Section 33-13-177 - Who may convene special courts-martial

In the state military forces not in federal service, the commanding officer of a garrison, fort, post, camp, air base, auxiliary air base or other place where troops are on duty, or of a division, brigade, regiment, wing, group, battalion, separate squadron, or other detached command, may convene special court-martial. Special courts-martial may also be convened by superior authority. When any such officer is an accuser, the court may be convened by superior competent authority if considered advisable by him.Former § 33-13-203 [Codes, 1942, § 8529-24; Laws, 1966, ch. 538, § 24] repealed by Laws, 1981, ch. 362, § 102, eff. 7/1/1981, amended and recodified as § 33-13-177 by Laws, 1981, ch. 362, § 26, eff. 7/1/1981.
