Section 37-9-61 - Unlawful reprisal against school district employee for employee's involvement in effort to create or encourage participation in public charter school prohibited

A school district, school district employee or any other person who has control over personnel actions may not take unlawful reprisal against an employee of the school district because the employee is directly or indirectly involved in an effort to create or encourage participation in a public charter school. As used in this section, the term 'unlawful reprisal' means an action which is adverse to the employee and results in one or more of the following for the employee:(a) Disciplinary or correction action;(b) Detail, transfer or reassignment;(c) Suspension, demotion or dismissal;(d) An unfavorable performance evaluation;(e) A reduction in pay, benefits or awards;(f) Elimination of the employee's position without a reduction in force by reason of lack of monies or work; or(g) Other significant changes in duties or responsibilities which are inconsistent with the employee's salary or employment classification.Added by Laws, 2016, ch. 420, SB 2161, 9, eff. 7/1/2016.
