Section 51-31-77 - Actual damages recoverable

In case any damages shall be allowed to any landowner for the construction of ditches across his said lands, actual damages shall be allowed. Such damages shall be paid in cash by giving to the party entitled thereto an order for the amount thereof on said district treasurer, who shall pay the same on presentation.Codes, 1906, § 1714; Hemingway's 1917, § 4303; 1930, § 4406; 1942, § 4611.
