Section 63-1-202 - Statement of intent and purpose

The purpose of this article is to implement the federal Commercial Motor Vehicle Safety Act of 1986 (49 USCS Section 31301 et seq.), hereinafter referred to as 'CMVSA,' and thereby prevent the loss to the State of Mississippi of substantial federal highway funds as a penalty for failure to comply therewith.This article is a remedial law which should be liberally construed to promote public health, safety and welfare. The provisions of Article 1 of this chapter, being the Highway Safety Patrol and Driver's License Law of 1938, and the provisions of Title 63, Chapter 11, Mississippi Code of 1972, being the Mississippi Implied Consent Law, including penalties for violations thereof, shall be applicable to the provisions of this article to the extent that such laws do not conflict with the provisions of this article. If any provisions of this article conflict with the provisions of the Highway Safety Patrol and Driver's License Law of 1938 or the Mississippi Implied Consent Law, then the provisions of this article shall control.
