Section 65-13-55 - Authority's procedures to conform to constitutions

Nothing in this chapter shall be construed to violate any provision of the federal or state constitutions, and all acts done under this chapter shall be done in such manner as will conform thereto, whether herein expressly provided or not. Where any procedure hereunder may be held by any court to be violative of either of such constitutions, the authority shall have the power by resolution to provide an alternative procedure conformable with such constitutions.Codes, 1942, § 8368-26; Laws, 1966, ch. 603, § 26, eff. 6/17/1966.
