All road authorities and contractors in counties, parts of counties, and municipalities in this state who construct, build, or repair public roads and streets with oyster shells shall, within ten days after the foundation is laid for such road, put a surface of crushed shells or other surfacing equal thereto for the purpose of making such roads smooth; and each half mile in rural districts and each block in cities shall be surfaced within said time after the foundation of such road shall be laid. All surface repair work shall be done with crushed shell, or material equal thereto, where the foundation is laid with such uncrushed oyster shells, so that said road shall be made smooth and traversable without injury to animal or vehicle.
