Section 7-1-59 - Court proceedings to be instituted

If the examiner report the state treasurer or any tax collector to be a defaulter, it shall be the duty of the governor to notify the attorney general in case of the state treasurer, or the proper district attorney in case of a county officer, of the facts and require him to institute proper proceedings in court for the investigation of such account and the judicial determination of the status thereof.Codes, 1892, § 2177; 1906, § 2394; Hemingway's 1917, § 4787; 1930, § 4841; 1942, § 3999.
