(1) Every corporation, company, association, partnership and individual person engaged in manufacturing of any kind in this state employing as many as fifty (50) or more employees and employing public labor, and every public service corporation doing business in this state shall be required to make full payment to employees for services performed as often as once every two (2) weeks or twice during each calendar month, or on the second and fourth Saturday, respectively, of each month. Such payment or settlement shall include all amounts due for labor or services performed up to not more than ten (10) days previous to the time of payment, except that public service corporations shall not be required to make payment for labor or services performed up to more than fifteen (15) days prior to the time of payment.(2) For the purposes of this section, the term 'employee' shall not include any individual employed in a bona fide executive, administrative or professional capacity.Codes, Hemingway's 1917, § 4530; 1930, § 4654; 1942, § 6994; Laws, 1916, ch. 241; Laws, 1991, ch. 407, § 1, eff. 7/1/1991.
