Section 73-19-5 - Penalty for violation of chapter; immunity from civil or criminal liability

(1) Any person violating the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction for his first offense shall be fined not more than five hundred dollars ($500.00) at the discretion of the court, and upon conviction for a second or later offense shall be fined not less than five hundred dollars ($500.00) nor more than one thousand dollars ($1,000.00) or imprisoned not less than six (6) months nor more than one (1) year, at the discretion of the court.(2) Any entity, organization or person, including the board, any member of the board and its agents or employees, acting in good faith and without malice, who makes any report or information available to the board regarding violation of any of the provisions of Sections 73-19-1 through 73-19-111, or who assists in the organization, investigation or preparation of any such report or information or assists the board in carrying out any of its duties or functions provided by law, shall be immune from civil or criminal liability for such acts.Codes, Hemingway's 1921 Supp. § 6124c; 1930, § 5654; 1942, § 8834; Laws, 1920, ch. 217; reenacted and amended, Laws, 1983, ch. 438, § 3; reenacted, Laws, 1991, ch.
