Section 77-5-511 - Certified copy of statement of willingness to take service from proposed system as prima facie evidence

In any proceeding for the enforcement of this article, a certified copy of the statement mentioned in Section 77-5-501 shall be admitted in evidence and shall be presumed to be prima facie proof of the verity and accuracy of all statements therein required by the provisions of said section. The burden of proof shall be upon any defendant in any such proceeding to rebut said presumption by a clear preponderance of the evidence.Codes, 1942, § 5496; Laws, 1938, Ex. ch. 77.
