Section 77-5-309 - Exercise of power of eminent domain

The board of supervisors of any county is expressly authorized to exercise the power of eminent domain anywhere in the state, within or without the boundaries of such county, in order to acquire any property, real or personal, necessary or useful in the furtherance of the provisions of this article. Any property so acquired shall be paid for only out of the earnings of the electric power system of such county, or from money borrowed as authorized under the provisions of Section 77-5-307.Codes, 1942, § 5433; Laws, 1934, ch. 291.
