Section 83-5-865 - Withdrawal of consent to receive electronic notices or documents

(1) A withdrawal of consent by a party shall not affect the legal effectiveness, validity or enforceability of a notice or document delivered by electronic means to the party before the withdrawal of consent is effective.(2) A withdrawal of consent by a party shall be effective within a reasonable period of time after receipt of the withdrawal by the insurer.(3) Failure by an insurer to comply with any provision of Section 83-5-857 or 83-5-859 may be treated, at the election of the party, as a withdrawal of consent for purposes of this article.Added by Laws, 2022, ch. 374, HB 1187,§ 8, eff. 7/1/2022.
