Section 83-23-105 - Application of article; exceptions

This article shall apply to all kinds of direct insurance except the following:(a) Life, annuity, health or disability insurance;(b) Mortgage guaranty, financial guaranty or other forms of insurance offering protection against insolvent risks;(c) Fidelity or surety bonds, or any other bonding obligations;(d) Credit insurance;(e) Insurance of warranties or service contracts;(f) Title insurance;(g) Ocean marine insurance;(h) Any transaction or combination of transactions between a person (including affiliates of such person) and an insurer (including affiliates of such insurer) which involves the transfer of investment or credit risk unaccompanied by transfer of insurance risk; and(i) Any insurance provided by or guaranteed by government.Codes, 1942, § 5814-53; Laws, 1970, ch. 446, § 3; Laws, 1992, ch. 412, § 1, eff. 7/1/1992.
