Section 91-27-15 - Capacity of transferor

(a) The capacity required to make or revoke a transfer-on-death deed is the same as the capacity required to make a contract.(b) A transfer-on-death deed may not be created through use of a power of attorney unless the transfer of real property through a transfer-on-death deed is specifically authorized in the power of attorney.Added by Laws, 2020, ch. 406, SB 2851,§ 8, eff. 7/1/2020.
