Section 91-31-5 - Applicability; relation to other law

Applicability; relation to other law.(a) This chapter applies to partition actions filed on or after July 1, 2020.(b) In an action to partition real property under Title 11, Chapter 21, Mississippi Code of 1972, the court shall determine whether the property is heir property. If the court determines that the property is heir property, the property must be partitioned under this chapter unless all of the cotenants otherwise agree in a record.(c) This chapter supplements Title 11, Chapter 21, Mississippi Code of 1972, and, if an action is governed by this chapter, replaces provisions that are inconsistent with this chapter.Added by Laws, 2020, ch. 433, SB 2553,§ 3, eff. 7/1/2020.
