Ask AI about this
If a person purchase land and die before paying therefor, the court may order the sale of personal property for the payment of the debt due for the land. If the personal property will not be sufficient, if sold, to pay the debt, or if it be advisable that the land be sold in preference to personal property to make payment therefor, the court may order the sale of such land on such terms as may be proper. In such case the vendor of the deceased and his assignee of the debt, if any, shall be made defendants to the petition for the sale of the land.Codes, Hutchinson's 1848, ch. 49, art. 1 (96); 1857, ch. 60, art. 138; 1871, § 1196; 1880, § 2043; 1892, § 1901; 1906, § 2076; Hemingway's 1917, § 1743; 1930, § 1690; 1942, § 587.
