Section 95-7-1 - Definitions

For the purposes of this chapter, the following words shall have the following meanings:(a) 'Apparently wholesome food' shall mean food that is prepared or perishable or raw agricultural products which appear to be fit for human consumption at the time it is donated. Such food does not include canned goods that are leaking, swollen, dented on a seam, or no longer airtight.(b) 'Charitable or nonprofit organization' shall mean an incorporated or unincorporated organization that has been established and is operating for religious, charitable, or educational purposes and that does not distribute any of its income to its members, directors or officers.(c) 'Intentional misconduct' shall mean conduct that the person acting knows is harmful to the health or well-being of another person.(d) 'Donate' shall mean to give without requiring anything of monetary value from the donee.(e) 'Person' shall mean an individual, corporation, partnership, organization or association.Laws, 1983, ch. 534, § 1, eff. 7/1/1983.
