It shall be unlawful for any locomotive or train of cars to be stopped or left standing on any railroad crossing, unless done under regulations adopted by those having the right to control such matter. Any person violating this section shall, on conviction be fined not less than one hundred dollars, nor more than one thousand dollars, or be imprisoned in the county jail for one year, or both; and if, in consequence of such violation, any person shall be killed or injured, the guilty party shall be imprisoned in the penitentiary not exceeding fifteen years.Codes, 1871, § 2423; 1880, § 1062; 1892, § 1274; 1906, § 1349; Hemingway's 1917, § 1083; 1930, § 1113; 1942, § 2349.
