Section 97-9-35 - Escape of prisoners; permitting escape

If any officer, or guard of the penitentiary, or any other person, shall, while any convict is under his keeping or charge, wilfully or negligently permit such convict to escape from custody, the person so offending shall be subject to indictment therefor, and, on conviction, shall be fined not more than one thousand dollars and be imprisoned in the penitentiary not less than one year nor more than two years, or in the county jail not less than six months, or shall be punished by both such fine and imprisonment.Codes, 1857, ch. 64, art. 98; 1871, § 2563; 1880, § 2803; 1892, § 1080; 1906, § 1160; Hemingway's 1917, § 887; 1930, § 913; 1942, § 2142.
