Title XII PUBLIC HEALTH AND WELFARE Chapter 198 • Effective - 28 Aug 1979 198.064. Duplicate payments — how determined — procedures for repayment. — 1. No operator shall retain any duplicate payment for the care of a resident received from any state agency or agencies. For the purposes of this section a duplicate payment is one which results in a total payment to the operator in excess of the per diem or monthly rate authorized by the agency or agencies. The operator shall report all such duplicate payments to the paying agency or agencies within five business days after such duplicate payment is discovered or reasonably should have been discovered. 2. The operator shall repay the excess amount in accordance with such procedures as the paying agency or agencies shall reasonably require, together with interest at the rate of one and five-tenths percent per month from the date the duplicate payment was discovered or reasonably should have been discovered. -------- (L. 1979 S.B. 328, et al. § 21)
