Title XII PUBLIC HEALTH AND WELFARE Chapter 208 Effective - 28 Aug 1987 208.305. Volunteers or designated elderly beneficiaries needing respite assistance to receive, when, qualifications — paid assistance, when, rate. — At such time as an elderly person who has done volunteer work under the program established under section 208.300, or the designated beneficiary, shall need assistance himself, he shall so notify the division and, if the division shall determine that such person is in fact in need of such assistance, which need shall not be based on financial need but on the social and medical condition of the person in question, such person shall receive the assistance of a volunteer. If no volunteer is available to assist a person entitled to assistance under this section because of his participation as a volunteer in the program established under section 208.300, and such unavailability has been verified by the division, the division, or an agency approved by the division, may obtain paid assistance for such person. Such paid assistance shall be at a rate which is no higher than the prevailing reimbursable rate established by the state for a unit of in-home services. , may obtain paid assistance for such person.
