Title XIV ROADS AND WATERWAYS Chapter 236 • Effective - 28 Aug 1979 236.455. Emergency action authorized. — If it is determined at any time that the condition of a dam or reservoir is an imminent and substantial threat, and so dangerous to public safety, life or property as not to permit time for issuance of an enforcement order to correct the hazard, the chief engineer may take any appropriate action not prohibited by the constitution or laws of this state he deems necessary for emergency protection of public safety, life or property, and may request the attorney general or a prosecuting attorney to take any legal steps necessary to accomplish such action and to recover the cost of such measures from the owner by appropriate legal action. -------- (L. 1979 H.B. 603 § 12)
