Title XXIX OWNERSHIP AND CONVEYANCE OF PROPERTY Chapter 448 • Effective - 28 Aug 1983 448.4-117. Effect of violations on rights of action — attorney's fees. — If a declarant or any other person subject to sections 448.1-101 to 448.4-120 fails to comply with any provision hereof or any provision of the declaration or bylaws, any person or class of persons adversely affected by such failure to comply has a claim for appropriate relief. Punitive damages may be awarded in the case of a willful, wanton and malicious failure to comply with any provision of sections 448.1-101 to 448.4-120. The court, in an appropriate case, may award reasonable attorney's fees. -------- (L. 1983 H.B. 177)
