Title XXVI TRADE AND COMMERCE Chapter 407 • Effective - 01 Aug 2002, see footnote 407.1340. Violation of dealer agreement. — Notwithstanding the terms of any RV manufacturer/dealer agreement, it shall be a violation of this chapter for: (1) Any warrantor to fail to indemnify and hold harmless its dealer against any losses or damages, to the extent such losses or damages are caused by the negligence or willful misconduct of the warrantor. The dealer shall provide to the warrantor a copy of pending suits in which allegations are made that come within this subsection within ten days of receiving such suit; (2) Any dealer to fail to indemnify and hold harmless its warrantor against any losses or damages, to the extent such losses or damages are caused by the negligence or willful misconduct of the dealer.
