Issuance of receipt without receiving grain — penalty. — A warehouseman who issues or aids in issuing a receipt knowing that the grain for which the receipt is issued has not been actually received by the warehouseman, or is not under his actual control at the time of issuing the receipt, is guilty of a felony and upon conviction shall be punished for each offense by imprisonment by the department of corrections and human resources for not to exceed five years. -------- (L. 1965 p. 606)
