§ 32-2-1217

32-2-1217. Violation of notice or final order -- penalties. Any present or former board member or officer of an institution or any other person against whom an outstanding and effective notice or final order has been served pursuant to 32-2-1205, 32-2-1207, or 32-2-1208 is subject to the penalties in 32-2-607(5) if the individual: (1) participates in any manner in the conduct of the affairs of the institution; (2) directly or indirectly solicits, procures, transfers, or attempts to transfer votes or attempts to vote any proxies, consents, or authorizations in respect to any voting rights in the institution; or (3) without the prior written approval of the commissioner, votes for a board member or serves as a board member, officer, or employee of the institution.
