39-51-2112. Benefit ineligibility for leave of absence. (1) An individual is ineligible to receive benefits during an approved leave of absence. (2) An individual is eligible to receive benefits when the individual returns to and offers service to the individual's employer after returning from an approved leave of absence and the individual's regular or comparable suitable work is not available, as determined by the department, provided that the individual is otherwise eligible.
