45-9-108. Exemptions. (1) The provisions of 45-9-107 do not apply to: (a) a drug manufacturer licensed by the state; (b) a person authorized by rules adopted by the board of pharmacy to possess the combination of substances; (c) a person employed by or enrolled as a student in a college or university within the state who possesses any combination of substances listed in 45-9-107 for the purposes of teaching or research that is authorized by the college or university. (2) The board of pharmacy shall adopt, amend, or repeal rules in accordance with the Montana Administrative Procedure Act to authorize the processing of any combination of the substances listed in 45-9-107 whenever it determines that there is a legitimate need and that the substances will be used for a lawful purpose.
