61-8-324. Overtaking vehicle on right. (1) The operator of a vehicle may overtake and pass on the right of another vehicle only under the following conditions: (a) when the vehicle overtaken is making or about to make a left turn; or (b) on a roadway with unobstructed pavement of sufficient width for two or more lanes of vehicles moving lawfully in the direction being traveled by the overtaking vehicle. (2) The operator of a vehicle may overtake and pass another vehicle on the right only under conditions permitting safe movement. The movement may not be made by driving off the pavement or main-traveled portion of the roadway, except that a person operating a bicycle may pass on the shoulder, provided the movement may be done in safety.
