7-2-2215. Election on question of creating new county -- proclamation and notice. (1) Within 2 weeks after the determination that the signatures on the petition are valid and sufficient, the board of county commissioners shall order and give notice of an election to be held for the purpose of determining whether the territory proposed to be taken from the county is to be established and organized into a new or enlarged county, for the election of officers, and for the location of a county seat if the vote at the election is in favor of the question. (2) The election must be conducted in accordance with Title 13, chapter 1, part 4. (3) All registered electors of the county are entitled to vote at the election. (4) If the proposed new county is an existing county to be enlarged by territory taken from the county in which the petition was filed, the board of county commissioners of the proposed new county shall also hold an election in the manner described in subsections (1) through (3).
