75-10-1410. Civil penalty. (1) A district court may assess a civil penalty upon a person who violates 75-10-1401 through 75-10-1405 of not more than $1,000 per day. (2) An action under this section is not a bar to enforcement by injunction or other appropriate civil remedy. (3) The penalty provided for in subsection (1) is recoverable in an action brought by the property owner and is payable to the property owner. The action must be filed in the district court of the county where the violation occurred. History: En. Sec. 6, Ch. 200, L. 2009.
