80-3-303. Powers and duties of department. (1) The department may: (a) enter a premises at any reasonable time to inspect produce for condition, for grade, for determining compliance with the provisions of this part, or for compliance with the FDA Food Safety Modernization Act, 21 U.S.C. 2201, et seq.; and (b) cooperate with and enter into agreements with governmental agencies of this state, agencies of other states, agencies of the U.S. government, and private associations, in furtherance of this part. (2) (a) The department shall adopt rules necessary for the efficient implementation of this part. (b) The department may adopt by reference regulations adopted under the FDA Food Safety Modernization Act, 21 U.S.C. 2201, et seq. History: En. Sec. 3, Ch. 553, L. 1993; amd. Sec. 1, Ch. 44, L. 2017.
