85-2-602. Definitions. Unless the context clearly requires otherwise, in this part the following definitions apply: (1) (a) 'Application' means an application for a permit under part 3 of this chapter to appropriate surface water from any source of supply within the basin for either or both of the following purposes: (i) a reservoir with a total planned capacity of 14,000 acre-feet or more; or (ii) for a flow rate greater than 20 cubic feet of water per second. (b) The term also includes an application for approval under 85-2-402 and 85-2-436, if applicable, to change the purpose of use. (2) 'Basin' means the Yellowstone River basin.
