§ 85-9-303

85-9-303. Termination plan -- court jurisdiction. (1) In the event the vote is for dissolution, any qualified elector or the board of directors of the district may, within the time fixed by the court, present a written plan for terminating the affairs of the district which shall include assignment of any water rights and works owned by the district. (2) The plan may specify that the affairs of the district shall be terminated by the directors or by a receiver appointed by the court. (3) On a day fixed by the court, the court shall consider the plan or plans and shall enter an order establishing a plan for the termination of the affairs. (4) The court shall retain jurisdiction to modify the plan and shall supervise the termination. History: En. Sec. 44, Ch. 100, L. 1969; R.C.M. 1947, 89-3444.
