Except as otherwise provided in NRS 239.0115, if: 1. The confidentiality of a public book or record, or a part thereof, is at issue in a judicial or administrative proceeding; and 2. The governmental entity that has legal custody or control of the public book or record asserts that the public book or record, or a part thereof, is confidential, the governmental entity has the burden of proving by a preponderance of the evidence that the public book or record, or a part thereof, is confidential.
