In each county whose population is 100,000 or more: 1. If the governing body of the county or any city in the county has adopted a building code, each such governing body shall, as part of its building code, adopt construction codes and energy codes that regulate: (a) The design of energy efficient residential, commercial and industrial structures; and (b) The installation of energy efficient mechanical, lighting and power systems in such structures. 2. If the governing body of the county or any city in the county has not adopted a building code, each such governing body shall: (a) By ordinance, adopt the codes described in subsection 1; and (b) Provide for the enforcement of such codes by the officers or employees of the county or city or by the officers or employees of another local government pursuant to an interlocal agreement. 3. The codes described in subsection 1 must: (a) Be adopted and become effective not later than January 1, 2002; and (b) Be applied to each new residential, commercial and industrial structure on which construction begins on or after the date on which the codes become effective.
