The board of trustees of a school district may divide the public schools within the school district into kindergarten, elementary, high school and other permissible departments, and shall employ competent and legally qualified teachers for the instruction of the different departments, if: 1. The division into departments is in accordance with the state courses of study and regulations of the State Board of Education; and 2. There is money for all of the departments, or if money is not available for all of the departments, the division is made in the order in which the departments are named in this section.
