Statute 40 020

If the defendant in such action disclaim in the defendant’s answer any interest or estate in the property, or suffer judgment to be taken against the defendant without answer, the plaintiff shall not recover costs. [1911 CPA § 573; RL § 5515; NCL § 9062]
