1. The Department may require the holder of a general permit to apply for and obtain an individual permit. 2. An individual permit may be required by the Department in any of the following cases, without limitation: (a) If the discharge or injection of fluids through a well is not in compliance with the conditions of the general permit. (b) If a change in circumstances has occurred and the general permit is no longer applicable. (c) If the Department determines that the discharge or injection of fluids is a significant or potentially significant contributor of pollutants. In making this determination, the Department may consider: (1) The location of the discharge or injection; (2) The size of the discharge or injection; and (3) The quantity and nature of the pollutants discharged or injected.
