Statute 463 425

1. Any disseminator who presents a proposal or user who presents evidence at the hearing conducted pursuant to NRS 463.424 may appeal the decision of the Board. The aggrieved party must file a petition with the Commission within 10 days after the Board issues its decision. 2. The party seeking the review bears the burden of proof. The Commission’s review must be confined to the record and is limited solely to a consideration and determination of the question of whether there has been an abuse of discretion by the Board in its decision. 3. The decision of the Commission is final and is not subject to judicial review. (Added to NRS by 1987, 1780)
