Statute 512 008

'Unwarrantable failure of an operator to comply' means the failure of an operator to prevent the occurrence of or to abate a violation of a health or safety standard or regulation adopted pursuant to the provisions of this chapter due to indifference, lack of diligence or lack of reasonable care.
