1. A person who violates any provision of NRS 597.814 is guilty of: (a) For a first offense, a misdemeanor. (b) For a second offense, a gross misdemeanor. (c) For a third and any subsequent offense, a category E felony and shall be punished as provided in NRS 193.130. 2. If a person is found guilty or guilty but mentally ill of, or has pleaded guilty, guilty but mentally ill or nolo contendere to, violating any provision of NRS 597.814, his or her telephone service to which a device for automatic dialing and announcing has been connected must be suspended for a period determined by the court. 3. In addition to any other penalty, a person who violates any provision of NRS 597.814 is subject to a civil penalty of not more than $10,000 for each violation. 4. A violation of any provision of NRS 597.814 constitutes a deceptive trade practice for the purposes of NRS 598.0903 to 598.0999, inclusive. (Added to NRS by 1999, 3332; A 2007, 1467; 2021, 1342)
