1. 'Home care employee' means a person who provides: (a) Personal care services through a home care program as an employee of a home care employer that is an agency to provide personal care services in the home; (b) Personal assistance through a home care program as a personal assistant for whom a home care employer that is an intermediary service organization is the employer of record; or (c) Temporary respite services through a home care program as an employee of a home care employer that has entered into a contract with the Aging and Disability Services Division of the Department of Health and Human Services to provide such services. 2.
