A person who: 1. During his or her last or next to last employment, performed services in the employ of a private employer while incarcerated in a custodial or penal institution; and 2. Is discharged from or leaves such employment because of his or her transfer or release from the institution, is ineligible for benefits for the week in which the person was discharged from or left such employment until that person earns remuneration in covered employment equal to or exceeding his or her weekly benefit amount in each of 10 weeks.
